Terms of Service

Overview

RooferWatch is an independent public-records project. We compile and publish information about roofing contractors using government and third-party data sources, including but not limited to Secretary of State filings, state licensing boards, OSHA enforcement records, EPA Lead-Safe (RRP) certifications, building-permit data, address-verification data, manufacturer certification programs, and publicly available reviews.

RooferWatch is an information service only. We are not a contractor, broker, lead-generation guarantor, lender, insurer, lawyer, or party to any agreement between a homeowner and a contractor. We do not perform roofing work, inspect roofs, or supervise any contractor.

Definitions

Visitor

anyone who accesses the Service without an account, such as a homeowner researching a contractor.

Member or Contractor

a business or person that creates an account, claims a listing, or purchases a paid membership.

Records

the data and information we compile from public and third-party sources and display on the Service.

Content

all text, data, compilations, designs, graphics, and other material we make available through the Service.

Our Information

Public records, not our opinions. The Records are gathered from government and third-party sources. We report what those sources show, with dates and citations where available. The Records are provided for general informational purposes only.

No guarantee of accuracy. We do not independently verify, and we do not warrant the accuracy, completeness, currency, or reliability of any Record. Source data may be outdated, incomplete, mismatched, or contain errors that originate with the source. Records reflect information available at a point in time and may change.

Absence of a record means nothing negative. Where the Service shows “no record found,” “not found,” “none,” or similar, this does not mean a contractor has done anything wrong, is unlicensed, is uninsured, or is out of compliance. It may reflect source limitations, reporting timing, differences between jurisdictions, a name or address mismatch, or that the matter is simply not publicly recorded.

Not an accusation or an endorsement. Nothing on the Service is intended as, or should be read as, a statement of fact or opinion accusing any business of wrongdoing, nor as a recommendation or endorsement of any business. A listing is generated from public data and does not require the listed business’s consent. Inclusion is not praise, and the presence or absence of any badge, chip, or status is not a verdict about a business’s character, quality, or fitness.

No affiliation. We are not affiliated with, sponsored by, or endorsed by any listed business, government agency, review platform, or product manufacturer. All trademarks, certification marks, and brand names are the property of their respective owners and are used for identification and reference only.

No Endorsement

RooferWatch does not recommend, endorse, certify, or guarantee any contractor. No badge, status, score, “Good Standing” indicator, or any other element of a profile is a warranty or guarantee of a contractor’s licensing, insurance, bonding, workmanship, honesty, financial condition, or fitness for any purpose.

You are solely responsible for your own hiring decisions. Before hiring any contractor, independently confirm their license, insurance, bonding, references, and any other facts that matter to you, and obtain a written contract. You use the Records and the Service at your own risk, and you agree that RooferWatch is not liable for the acts, omissions, work, or conduct of any contractor listed on or contacted through the Service.

Corrections

We want the Records to be as accurate as the underlying sources allow. If you believe a Record about you or your business is inaccurate, you may submit a correction request from your account, through a support ticket, or by email at support@rooferwatch.com.

We will review reasonable, specific, good-faith requests and, where a correction is warranted and verifiable against the underlying source, we will update, annotate, or remove the affected Record at our discretion. We are not obligated to remove accurate information drawn from a public source. Where a source itself is the origin of an error, we may direct you to correct it at the source.

Member Verification

Eligibility and accuracy. To create a Member account or claim a listing, you must be authorized to act for the business and must provide accurate, current, and complete information. You are responsible for all activity under your account and for keeping your credentials secure.

Ownership verification. Before changes you submit appear on the public-facing profile, we may require you to verify your authority to control the listing (for example, by phone, business email, mailing verification, or license cross-check). Verification is free and is not a paid feature. We may decline, suspend, or revoke a claim or any account if we reasonably believe the information is false, the claimant lacks authority, or verification cannot be completed.

Payment never changes the Records. Membership is a commercial relationship for profile features, alerts, lead delivery, or other paid services. Membership does not, and is not intended to, alter, improve, suppress, or influence any Record or public-records status. A “Member” designation reflects a paid business relationship and nothing more.

Membership and Billing

Subscriptions. Paid memberships are sold on a recurring subscription basis. By starting a paid membership, you authorize us and our payment processor to charge your payment method the then-current fees, plus applicable taxes, on a recurring basis until you cancel.

Automatic renewal. Memberships renew automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. You may cancel at any time through your account or by contacting us; cancellation takes effect at the end of the current billing period.

Price changes. We may change fees or introduce new charges. We will give you reasonable advance notice of a price increase, and the new price applies to your next billing period after the notice. Your continued use after the change takes effect constitutes acceptance.

No refunds. Except where required by law, fees already charged are non-refundable, and partial billing periods are not prorated or credited on cancellation. We do not provide refunds or credits based on lead volume, lead quality, lead outcomes, business results, or your level of use.

Failed payments. If a charge fails, we may suspend or downgrade paid features until payment is resolved.

Taxes. You are responsible for any sales, use, or similar taxes associated with your membership, other than taxes on our income.

Leads

If your membership includes leads, the following applies:

• Leads are shared, not exclusive. The same consumer inquiry may be delivered to multiple contractors at the same time.
• We make no guarantee as to the number, quality, validity, intent, conversion, or value of any lead, or that any lead will result in a contract or revenue.
• We are not responsible for a consumer’s accuracy, conduct, decisions, or whether a consumer responds, hires, pays, or proceeds.
• You may use leads only to offer your own roofing services. You may not resell, redistribute, scrape, or repurpose leads, and you must handle consumer information lawfully, including under applicable privacy and anti-spam laws (for example, the TCPA and CAN-SPAM).
• Lead fees are part of your subscription fee and are subject to the no-refund terms in Section 7.

Acceptable Use

You agree not to:

• scrape, crawl, harvest, copy, or systematically extract the Records, Content, or any substantial part of the database, except for ordinary personal browsing;
• resell, sublicense, or redistribute the Records or Content as a competing dataset or product;
• use the Service to harass, threaten, defame, or abuse any listed business or any person;
• submit false, misleading, or fraudulent information, including false claims of ownership;
• attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with the Service’s operation or security;
• use automated means to create accounts or submit requests at scale; or
• use the Service in violation of any applicable law.

We may suspend or terminate access for any violation of this Section.

Intellectual Property

Individual facts and public records are not owned by us. However, the selection, arrangement, compilation, design, presentation, written summaries, and overall database that make up the Service are owned by RooferWatch and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. All rights not expressly granted are reserved.

If you submit content to us (for example, corrections, descriptions, or profile information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and incorporate that content into the Service.

Third-Party Sources

The Service relies on and links to government databases, third-party platforms, and external websites that we do not control. We are not responsible for the accuracy, availability, content, or practices of those sources or sites. Links and citations are provided for reference and do not imply endorsement.

Warranty Disclaimer

The Service and all Records and Content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty of accuracy, completeness, or uninterrupted or error-free operation. We do not warrant that the Records are correct, current, or suitable for any decision you make.

Liability

To the fullest extent permitted by law, RooferWatch and its owners, members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to the Service, the Records, any contractor or consumer, or these Terms, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless RooferWatch and its owners, members, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, your violation of these Terms or any law, or, if you are a Contractor, your work, conduct, or dealings with any consumer or lead.

Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to that policy.

Dispute Resolution

Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Informal resolution first. Before filing any claim, you agree to contact us at legal@rooferwatch.com and attempt to resolve the dispute informally for at least thirty (30) days.

Binding arbitration and class waiver. Except for claims that qualify for small-claims court and except for requests for injunctive relief to protect intellectual property, any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by a recognized arbitration provider, conducted in or by video for Ventura County, California. You and RooferWatch waive any right to a jury trial and to participate in a class, collective, or representative action. Disputes will be brought only in an individual capacity.

Venue for non-arbitrable matters. For any claim not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Ventura County, California.

Termination

We may suspend or terminate your access to the Service, remove or modify any listing, or discontinue any feature, at any time and for any reason, including if you violate these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 3, 4, 10, 12, 13, 14, and 16) will survive.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify Members. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

General

These Terms are the entire agreement between you and RooferWatch regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the rest remains in effect, and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
